Alaska Airlines Class Action Victory for Corr Cronin Thursday, September 26, 2002Corr Cronin today was successful in getting yet another class action case thrown out of court. Following up on its class action victories for Exxon and ANC Rentals, Corr Cronin obtained a dismissal of a class action against Alaska Airlines that involved 3.9 million members and claims dating back to l996. The case was brought by Richard Greenfield, a nationally known player in numerous class action cases. In this case, Greenfield claimed that Alaska Airlines had breached its contract and acted unfairly when it "retroactively devalued" the mileage owned by frequent flyers when Alaska increased its award levels. Corr Cronin successfully argued that the plaintiffs' claims were preempted; that any covenant of good faith and fair dealing did not trump Alaska's explicit contract rights and that the contract was not ambiguous. After extensive briefing and oral argument, the judge dismissed the entire case with prejudice. Greenfield currently has pending frequent flyer class actions against Northwest Airlines in Michigan and against Continental Airlines in New Jersey. ← Back ↑ Top
