Corr Cronin recently secured a trial victory in a case involving the enforcement of a personal guaranty worth more than $5 million. The guaranty arose under a loan tied to multiple commercial fuel deliveries.
The defense sought to avoid liability by pointing to a mistake in the written contract and arguing that the document reflected the guarantor’s true understanding. To prevail, Corr Cronin’s team had to establish—by the demanding standard of “clear, cogent and convincing evidence”—that the contractual mistake was inconsistent with the actual intent of the parties.
After a full trial, the court found that Corr Cronin not only met but exceeded that burden, concluding that the firm had presented “overwhelming” evidence of the true agreement. The ruling was in our client’s favor and enforced the guaranty.
